DMCA Policy
India Tactical Shift ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.
This policy outlines the procedures for submitting a copyright infringement notification and for submitting a counter-notification, should your content be subject to removal.
Filing a DMCA Notice of Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on our services infringes upon your copyrights, you may submit a written notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:
- Identification of the copyrighted work claimed to have been infringed: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing: A description of the material that you claim is infringing and where it is located on our website (e.g., URL of the specific page, detailed path to the content). Please provide reasonably sufficient information to permit us to locate the material.
- Your contact information: Your name, address, email address, and telephone number.
- A statement that you have a good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Filing a DMCA Counter-Notification
If you believe that material you posted on our site was removed or disabled by mistake or misidentification, you may submit a counter-notification by providing our Designated Copyright Agent with the following information in writing:
- Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., URL of the specific page).
- A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your name, address, email address, and telephone number.
- A statement consenting to the jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the U.S., for any judicial district in which India Tactical Shift may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature: Your physical or electronic signature.
